Terms of Service

1. Agreement

By accessing the Heartsez website or submitting a request for services, you agree to these Terms. If you do not agree, please do not use the site or submit a service request.

2. What Heartsez provides

Heartsez offers professional property stewardship, which may include Startup Visits, Monthly W.A.S. Visits, property documentation, Property Profile records, Property Health tracking, Property Timeline history, and Heart Intelligence recommendations.

Heartsez is not a realtor, home listing service, handyman marketplace, emergency repair service, or licensed contractor marketplace unless separately agreed in writing.

3. Inquiries and Startup Visits

Submitting a form on our website does not create a paid service agreement by itself. A request helps us confirm property details and discuss next steps. Enrollment, pricing, visit schedules, and service inclusions are confirmed separately before services begin.

4. Service scope

Monthly W.A.S. Visits are structured stewardship visits focused on Wellness, Aesthetics, and Safety documentation and observation. They are not intended as comprehensive engineering inspections, appraisals, insurance inspections, or guarantees of property condition.

Additional hands-on work, if available under your plan, may be limited by agreed scope, technician capacity, safety considerations, and property access.

5. Property access and accuracy

You are responsible for providing accurate property information, authorizing access for scheduled visits, and ensuring the property is safe to enter. You agree not to request services you are not authorized to request for a given property.

6. Documentation and recommendations

Property Profile records, photos, notes, checklists, Property Health scores, timelines, and Heart recommendations are provided to support visibility, prevention, documentation, and informed decisions. They are advisory and evidence-based where available, but they are not legal advice, engineering determinations, appraisal opinions, or guarantees of resale value, buyer interest, appraisal outcomes, or insurance results.

7. Accounts and portal use

If you are given access to a Heartsez customer portal, you are responsible for protecting your login credentials and for activity under your account. You may not misuse the platform, attempt unauthorized access, or interfere with service operations.

8. Payments and plans

If you enroll in a paid plan, pricing, renewal, cancellation, and billing terms will be described in your plan confirmation or customer agreement. Fees may change with notice as described in those materials.

9. Intellectual property

The Heartsez name, branding, website content, platform designs, and related materials are owned by Heartsez or its licensors. You may not copy, redistribute, or commercialize site content without prior written permission.

10. Acceptable use

You agree not to:

• use the website or services for unlawful purposes;
• submit false, misleading, or unauthorized information;
• attempt to reverse engineer, scrape, or disrupt Heartsez systems;
• harass team members or misuse communications channels.

11. Disclaimers

The website and services are provided on an “as available” basis. To the fullest extent permitted by law, Heartsez disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, error-free documentation, or that every property issue will be identified or prevented.

12. Limitation of liability

To the fullest extent permitted by law, Heartsez is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the website or services. Our total liability for any claim related to the website or a given service period will not exceed the fees paid to Heartsez for the services giving rise to the claim during the three months preceding the claim, unless a customer agreement states otherwise.

13. Indemnification

You agree to indemnify and hold Heartsez harmless from claims arising out of your misuse of the website or services, inaccurate information you provide, or unauthorized requests for property access or services.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.

15. Changes

We may update these Terms from time to time. Continued use of the website after changes become effective constitutes acceptance of the updated Terms. Material service terms for enrolled customers may also be governed by a separate customer agreement.
